Terms and Conditions for Santa’s Grotto and Santa's Enchanted Forest
These terms and conditions apply to your purchase of tickets for Santa’s Grotto at South Downs Nurseries and tickets for Santa's Enchanted Forest at Old Barn Garden Centre, operated by Tates of Sussex Garden Centres on behalf of The Budding Foundation, charity no. 1155335.
Please read these terms and conditions carefully, particularly the section regarding cancelling or amending your tickets. By ticking the ‘I agree to the terms and conditions’ box, you confirm that you are happy to be legally bound by these terms and conditions.
If you do not agree to these terms and conditions, you should not tick the ‘I agree to the terms and conditions’ and should not continue with the purchase of tickets for Santa’s Grotto or Santa's Enchanted Forest.

1. Definitions
1.1 “We”, “Us”, “Our” refers to Tates of Pyecombe Ltd T/A Tates of Sussex Garden Centres South Downs Nurseries and Old Barn Garden Centre.
1.2 “You”, “Your” refers to the individual purchasing tickets and/or attending the event.
1.3 "Event" refers to Santa’s Grotto at South Downs Nurseries or Santa's Enchanted Forest at Old Barn Garden Centre.
1.4 "Ticket" refers to the admission ticket purchased for the Event.
2. Santa’s Grotto and Santa's Enchanted Forest
2.1 Locations
- Santa’s Grotto operates at South Downs Nurseries, Brighton Road, Hassocks, West Sussex, BN6 9LY. It is operated by Tates of Sussex Garden Centres on behalf of The Budding Foundation, charity no. 1155335. All profits from ticket sales are used by the charity to fund charitable projects.
- Santa's Enchanted Forest operates at Old Barn Garden Centre, A24 Dial Post, Horsham, West Sussex, RH13 8NR. It is operated by Tates of Sussex Garden Centres on behalf of The Budding Foundation, charity no. 1155335. All profits from ticket sales are used by the charity to fund charitable projects.
2.2 Ticket Admission
Admission to Santa’s Grotto or Santa's Enchanted Forest is only accepted upon receipt of a valid ticket, purchased online via www.tatesofsussex.co.uk. Tickets must be presented in printed form or viewable on a mobile device.
2.3 Proof of Identity
We reserve the right to request proof of identity before allowing admission to Santa’s Grotto or Santa's Enchanted Forest.
2.4 Arrival Time
You must arrive at least TEN (10) minutes in advance of your allocated time slot. We will use our reasonable endeavours to admit latecomers, but late admission cannot be guaranteed.
2.5 Supervision
You shall be responsible at all times for ensuring the correct and safe supervision of all children in your group. Children must be accompanied by a responsible adult aged 18 or over at all times.
2.6 Health and Safety
You agree to comply with any health and safety protocols in place during your visit to Santa’s Grotto or Santa's Enchanted Forest. We reserve the right to refuse admission or remove any attendee who does not comply with these measures.
2.7 Code of Conduct
We expect all visitors to behave in a respectful and appropriate manner. We reserve the right to refuse entry or remove any guest whose behaviour is disruptive or disrespectful to staff, volunteers, or other visitors, without refund.
3. Purchasing Your Tickets
3.1 Availability
Tickets to Santa’s Grotto and Santa's Enchanted Forest are available to purchase online through www.tatesofsussex.co.uk and are subject to availability.
3.2 Payment
Payments for tickets must be made via the online payment facility, provided by Barclaycard and Opayo. We do not store your payment card details.
3.3 Ticket Validity
Your ticket is only valid for the date and time specified on your ticket.
3.4 Unlawful Resale
Unlawful resale (or attempted unlawful resale) of a ticket will result in the cancellation of that ticket without refund or other compensation.
3.5 Lost or Stolen Tickets
We are not responsible for any tickets that are lost or stolen. You are responsible for ensuring that you have a valid ticket ready to be inspected upon your arrival.
4. Cancelling or Amending Your Tickets
4.1 Non-Refundable
Tickets to Santa’s Grotto and Santa's Enchanted Forest are non-refundable.
4.2 Rescheduling
You may be able to change your allocated time slot up to 48 hours prior to your scheduled time, subject to availability, by logging into your Digitickets account if you have one, or notifying us via email: help@tatesofsussex.co.uk.
4.3 Event Cancellation
We may cancel or reschedule your visit to Santa’s Grotto or Santa's Enchanted Forest at any time at its absolute discretion. If a suitable timeslot cannot be found, we will offer you a full refund.
4.4 Illness or Personal Emergency
If you or a member of your group is unable to attend the event due to illness or a personal emergency, tickets will not be refunded. However, we may offer the opportunity to reschedule your visit, subject to availability and provided sufficient notice is given.
5. Photography
5.1 Personal Photography
You are permitted to take photographs during your visit, but these must only include your family members. Respect for the privacy of other guests must be maintained at all times.
5.2 Event Photography
By purchasing a ticket and attending Santa’s Grotto or Santa's Enchanted Forest, you grant us the right to take photographs of your visit and use those images for publicity purposes in connection with the event, including but not limited to, use on The Budding Foundation or Tates of Sussex social media channels and public relations materials.
6. Your Privacy
6.1 Personal Data Processing
By providing your personal information when purchasing your ticket, you consent to us processing your data in accordance with these terms and our privacy policy.
6.2 Third-Party Processing
The personal information you provide when purchasing your ticket is held by Digitickets, a third-party supplier providing the online platform. You can view their privacy policy here: http://www.digitickets.co.uk/privacy-policy.
6.3 Data Protection Compliance
Your personal information is collected and stored in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
6.4 Data Rights
You have the right to request access to, rectify, or erase your personal information. You can also request restrictions on processing or object to processing under certain circumstances. To exercise these rights, contact us at help@tatesofsussex.co.uk.
7. Liability
7.1 Limit of Liability
Our liability for any losses you and/or your guests may suffer as a result of breaching these Terms and Conditions is strictly limited to the total purchase price of your tickets.
7.2 Exclusion of Certain Losses
To the maximum extent permitted by law, we, our volunteers, Trustees, or Tates of Pyecombe Ltd., will not be liable for: a. Loss of data; b. Loss of profit, revenue, or business opportunity; c. Loss of goodwill; d. Disappointment or emotional distress; e. Any indirect, consequential, or special loss; arising in connection with Santa’s Grotto or Santa's Enchanted Forest.
7.3 Liability for Death or Injury
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded by law.
7.4 Personal Belongings
We are not responsible for any loss, theft, or damage to your personal belongings during your visit to Santa’s Grotto or Santa's Enchanted Forest.
8. Events Outside Our Control
8.1 Force Majeure
We will not be liable for any failure or delay in performing our obligations caused by events beyond our reasonable control ("Force Majeure Event").
8.2 Force Majeure Events Include: a. Strikes, lock-outs, or industrial action; b. Civil commotion, riot, invasion, or terrorist attack; c. Fire, explosion, storm, flood, earthquake, or other natural disaster; d. Impossibility of telecommunications networks; e. Acts, decrees, legislation, or restrictions of any government; f. High winds or other extreme weather conditions.
8.3 Event Rescheduling Due to Force Majeure
If a Force Majeure Event results in the cancellation of your booking, we will make reasonable efforts to reschedule. If no suitable alternative can be offered, we will provide a refund of the ticket price.
9. Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any dispute under these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
10. Complaints
If you have a complaint during your visit, please inform a member of the team immediately and they will attempt to resolve the problem. If an acceptable solution is not found, please email help@tatesofsussex.co.uk with full details of the complaint within.
